Plain-Language Summary
This summary is a courtesy and is not legally binding.
- Your data is yours. Everything you put into PickleDash stays yours. Export it as CSV anytime, on any plan, including the free plan.
- Cancel anytime. No contracts, no penalties. Paid plans renew automatically, so cancel before your renewal date to avoid the next charge.
- We never sell your data. We use it only to run the service for you.
- The free plan is truly free. No expiry, no card required, just feature limits.
- Use it fairly. Run your club, follow the law, and don't abuse the platform.
1. Who We Are and What This Covers
PickleDash ("we", "us", "PickleDash") provides a web platform that helps pickleball clubs and court facilities manage sessions, courts, members, payments, leagues, and communications (the "Service").
By creating an account or using the Service, you agree to these Terms of Service (the "Terms"). If you do not agree, do not use the Service. These Terms also incorporate our Privacy Policy, Acceptable Use Policy, and Cookie Policy.
You must be at least 18 and have authority to bind any organization you represent.
2. Your Account
You are responsible for the accuracy of your account information, for keeping your login credentials secure, and for activity under your account. Tell us right away at info@pickledash.com if you suspect unauthorized access.
3. Plans, Billing, and Renewal
We offer a free plan and paid plans. Current pricing, plan features, and any discounts are always shown at pickledash.com/pricing.
- Free plan: no cost, no expiry, no card required. Feature limits apply.
- Paid plans: billed in advance for the period you choose. Paid plans renew automatically at the end of each period unless you cancel beforehand.
- Cancellation: cancel anytime in your account settings or by emailing us. Cancellation takes effect at the end of the current paid period; you keep access until then. We do not refund partial periods.
- Price changes: we will give reasonable advance notice by email. If you don't accept a change, cancel before it takes effect.
4. Your Data and Your Members' Data
You own all the data you put into the Service, including member information, payment records, and league results. We claim no ownership of it and we never sell it.
You're responsible for your members' data: we process it only to run the Service for you, on your behalf, and according to your use of the platform. You are responsible for having a lawful basis to collect and use that data and for meeting your obligations under applicable privacy law (in Québec, Law 25 and PIPEDA).
You can export your data as CSV at any time, on every plan. After you cancel or close your account, your data stays accessible for a reasonable period so you can export it, after which we delete it, except where we must keep certain records (such as payment records) to meet legal or tax obligations. See our Privacy Policy for details.
5. Acceptable Use
You agree to use the Service only to run a legitimate pickleball club or court facility, and to follow our Acceptable Use Policy, which forms part of these Terms. In short: no illegal activity, no spam, no harassment, no scraping or automated extraction, no attempts to reverse engineer or break the platform, and no unauthorized access to other users' accounts or data.
6. Our Intellectual Property
The Service itself, including its software, design, and branding, belongs to PickleDash. These Terms give you a limited right to use the Service and nothing more. If you send us feedback or suggestions, we may use them freely to improve the Service.
7. Service "As Is" and No Warranties
We work to keep the Service available and reliable, but we don't guarantee uninterrupted or error-free operation. The Service may be unavailable for maintenance or for reasons beyond our control, and we may add, change, or remove features.
To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
8. Limitation of Liability
To the fullest extent permitted by law:
- We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or lost business opportunities.
- Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the event giving rise to the claim (or a nominal amount if you use only the free plan).
9. Suspension and Termination
You can close your account at any time. We may suspend or terminate your account if you materially break these Terms or the Acceptable Use Policy. Where practical, we will give notice and a chance to fix the problem first, but we may act immediately for serious issues such as illegal activity or security threats. After termination, we will make reasonable efforts to let you export your data for a reasonable period, unless the law prevents it.
10. Changes to These Terms
We may update these Terms from time to time. For material changes, we will give reasonable advance notice by email. Continuing to use the Service after a change takes effect means you accept the updated Terms. The current version is always at pickledash.com/legal/terms.
11. Governing Law and Disputes
These Terms are governed by the laws of the Province of Québec and the federal laws of Canada that apply there, without regard to conflict-of-law rules. You agree that the courts of the Province of Québec (judicial district of Montréal) have jurisdiction over any dispute, subject to any mandatory consumer-protection rights you may have. Before starting any formal proceeding, the parties agree to try to resolve the dispute in good faith by contacting each other in writing.
12. General
If any part of these Terms is unenforceable, the rest stays in effect. You may not transfer your rights under these Terms without our consent; we may transfer ours in connection with a merger, acquisition, or sale of our business, with notice to you. These Terms, together with the Privacy Policy, Acceptable Use Policy, and Cookie Policy, are the entire agreement between you and PickleDash about the Service. Our failure to enforce a provision is not a waiver of it. We are not liable for delays or failures caused by events beyond our reasonable control.
